2. Scope

These terms apply to your use of MatchReactions and all its features.

3. Eligibility and Minimum Age

You must be at least 16 years old to create an account and use this service. By signing up, you confirm that you meet this minimum age requirement.

4. Your Account

To use certain features, you must sign up using a third-party authentication provider (such as Google). You agree to provide accurate information. You are solely responsible for maintaining the security of your account credentials. Accounts are for individual use only—one person per account, and no sharing of access is permitted.

5. Your Content and Rights

Our service allows you to upload and enter content, including team crests, club logos, custom images, and text.

• Ownership: You retain full ownership of any content you upload or create. We do not claim ownership of your data.
• License to Us: By uploading content, you grant us a limited, worldwide, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating the service (such as rendering overlays visible to your viewers on public URLs).
• Your Warranties: You warrant that you hold all necessary rights, licenses, and permissions to any club crest, logo, team name, player name, or image you upload.
• Indemnification: You agree to indemnify and hold us harmless against any claims by third parties arising from a culpable (negligent or intentional) infringement of their rights by the content you upload.

Takedown Notices: We respect intellectual property rights. If you believe your copyright or trademark has been infringed by content hosted on our service, please send a notice to fabian.gadau@gmail.com. We may remove or disable access to allegedly infringing content upon receipt of a valid notice.

6. Acceptable Use

When using our service, you agree not to:

• Upload illegal content or infringe on third-party rights.
• Post harassment, hate speech, or explicit material.
• Attempt to circumvent any limits, security features, or disrupt the service.
• Use automated systems (like bots or scrapers) to extract data from the service.
• Resell access to the service or its underlying technology.

7. Availability

This service is provided free of charge and "as-is". We do not guarantee any specific uptime or availability, and we do not offer a Service Level Agreement (SLA). We reserve the right to modify, suspend, or discontinue the service at any time.

Additionally, certain features may rely on third-party APIs (such as Twitch or YouTube). We are not responsible if these features break or become unavailable due to changes made by those third-party platforms.

8. Suspension and Termination

We reserve the right to suspend or terminate your account if you breach these terms or upon receiving a valid notice of rights infringement. Where reasonable, we will provide notice before taking such action.

You may stop using the service and request to delete your account at any time. Upon deletion, your profile and associated uploads will be removed from our active systems.

9. Liability

Because this service is provided free of charge, our liability is limited in accordance with German law.

We are fully liable for damages resulting from intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), as well as for damages resulting from injury to life, body, or health.

In cases of slight negligence, we are only liable if we breach a material contractual obligation (Kardinalpflicht)—an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely. In such cases, our liability is limited to foreseeable, typical damages. Any further liability for damages is excluded.

10. Changes to these Terms

We may update these terms occasionally. If we make material changes, we will notify you (for example, by displaying a notice in the app). Your continued use of the service after changes take effect means you accept the new terms. If you do not agree to the changes, you must stop using the service.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. To the extent legally permissible, the place of jurisdiction for all disputes arising from or in connection with these terms is Bochum, Germany.

12. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
